Personal Assurance Platform Act

The Personal Assurance Platform Bill forms part of Ostentia's National Emergency Plan.
This bill is being presented in a new bill format, chose for ease of reading and depth of detail.
PREAMBLE:
The Personal Assurance Platform is an administrative determination by competent authority that an individual is eligible and suitable, from a security stand-point, for access to security classified resources including government in-confidence, national utility workers and various other roles which could, if acted in by a dubious character, could result in national security issues for Ostentia.
PRINCIPAL OBJECTS OF THIS ACT: A series of assessments and background checks to ensure that people entrusted with security classified resources:
( a ) are eligible to have access ( b ) have had their identity established ( c ) are suitable to have access, and ( d ) are willing to comply with the standards that safeguard those resources against misuse.
SUMMARY OF ACT: The Personal Security Platform is designed to limit the risk of sensitive and classified information being accessed by unauthorised organisations and persons, such as:
- foreign intelligence services - those who wish to overthrow or undermine the government by unconstitutional or violent means. - terrorist groups, and - individuals who may be susceptible to pressure or improper influence - have shown dishonesty or lack of integrity which casts doubts upon their suitability, or - have demonstrated behaviour or are subject to circumstances which may otherwise indicate unreliability.
The security clearance process also identifies clearance subjects, who may not be members of the above, but may be subject to undue influence from these organisations or people.
A security clearance will be sought for persons with a legitimate need to access security classified resources in order to carry out their duties. These people may include:
- Ostentian public servants - members of the security and intelligence community - members of the armed forces - State public servants who receive and utilise Ostenita security classified material or other valuable resources - Ostentia Federal Police officers - contractors who provide goods and services to the Commonwealth, States and Territories - other persons who are provided with security classified material by a government agency - persons who have access to valuable resources, and - persons who have access to classified IT systems.
Personal Assurance Platform determines a persons suitability to access security classified resources through the assessment of a number of suitability indicators, including the person’s:
- honesty - trustworthiness - maturity - tolerance, and - loyalty.
These suitability indicators as well as an appreciation of protective security responsibilities and obligations determines a persons suitability.
A number of background assessments and records checks are also conducted to identify vulnerabilities against factor areas including:
- external loyalties, influences and associations - personal relationships and conduct - financial considerations - alcohol and drug usage - criminal history and conduct - security attitudes and violations, and - mental health disorders.
Rights of people gaining clearances under the Personal Assurance Platform:
- as the security clearance process is inherently intrusive, agencies will respect the employees privacy and dignity at all times. Any consent obtained to conduct checks and inquiries would be confirmed in writing and the employee should understand all aspects of the process - agencies must not discriminate against clearance subjects on any unlawful basis, for example race, age, criminal history, gender or sexual preference and, - agencies must assess clearance subjects based on the ‘whole person principle’, ie the agency considers factors relevant to the clearance process in the context of the clearance subject’s whole life and range of experiences so that the assessing officer develops an accurate assessment of the clearance subject as a unique individual.

This is a bill designed to create the necessary framework for the creation of national or regional referenda. It will replace all current regional legislation on the matter
Process - A bill calling for a referendum will first be put before the House, laid out in the below-specified format - Referendums will cost a one-time fee of one unit to undertake be covered by the current administration budget - On passage, the referendum will take place on the specified date, with any action decided on becoming law by popular consent.
Bill Format Title: Referendum on <Proposed Subject> Region Affected: <National/Regional/Local/Combination/Other> Date: <The date on which polling will take place, preferably the same date as a general election> Questions asked: <An unlimited number of questions can be posed, although keep it reasonable> Effects of Questions: <Here detail the effects that the results of the different questions will have> Threshold: <If not specified, this will be set at 50% for an option needed to be successful. One may wish to increase or decrease this however, to increase legitimacy or account for multiple options>
Aims Through direct democracy, people can be involved in new ways in the political system, granting further legitimacy to any political decisions undertaken. This can be particularly useful in the case of constitutional amendments or other controversial measures which the public ought to be allowed to vote on directly.

Title: Referendum on the Creation of a Federal Republic Region Affected: National Date: As soon as feasibly possible. Question asked: Should the current constitution be replaced with the proposed federal constitution? Effect of question: If passed, then the constitution shall be amended, with article 11a being struck off the record. The constitution will then be replaced with the new constitution proposed by the Campaign for a Federal Republic. Threshold: 55%
As this bill potentially amends the constitution, it shall be subject to a two thirds vote in the House of Commons.

Under this bill,
1) All acts regarding the NEA are to be suspended until further notice.
2) All governments and authorities and armed factions that have arisen in Ostentia as a result of the recent crisis shall be compelled to recognise that a state of normality has returned and democratic government has been resumed.
3) All executive actions allegedly ordered during the crisis by the coup leaders shall be declared null and void.
4) The heads of all public agencies which recognised the falsely claimed authority of the coup leaders shall be suspended from their posts, pending investigation by a cross-party parliamentary committee, to be established by this bill and composed of back benchers. Any official found to have willingly overlooked the exact nature of the powers granted by the NEA Acts shall be sacked.

An organisation will be set up to create standardised values, definitions, etc. These will be mostly of a scientific nature(e.g. ISO setting for cameras) or for reference (e.g. ISBN numbers). Countries will be invited to join the organisation and participate in the decision making, thus allowing standards to be the same across a variety of countries, making trade and sharing research and technology a lot easier, as products are compatible across the countries.

Ostentian Rebate Act

I, the Right Honourable Kay "DynamoJax" Jackson, the Prime Minister of the Federal Republic of Ostentia do hereby introduce to the Ostentian House of Comons thereof:
AN ACT to disburse unused budget units to the people of Ostentia via Rebate.
§1. SHORT TITLE.
This Act may be referred to as the Ostentian Rebate Act of 2009.
§2. THE ACT AND ACTION
Effective upon enactment, the government shall disburse two (2) budgetary units to be distributed amongst all citizen taxpayers of Ostentia. Each taxpaying citizen of Ostentia shall receive an equal amount of money regardless of the tax paid.
§3. LOCATION OF FUNDS
The Budget Units may be found under the "Rebate" line of the Budget.
§4. DURATION
This act, upon enactment, shall last for the duration of the parliamentary term.
§5. MECHANISM FOR RENEWAL AND MODIFICATION
This act may be renewed each parliamentary session, and the amount and the fractionof the rebate may be adjusted with each renewal should the incumbent government desires it so.
§6. EXPIRY
Should this act not be renewed, it shall be considered dormant. This act must be renewed in order for units to be disbursed again. The act shall be considered repealed if a seperate motion to repeal the act is moved and passed.

National Secrets Act

Under this bill,
1. Cabinet office documents relating to national security, and only those relating to national security, may be classified as TOP SECRET. This is to be done at the request of ministers and with the approval of the speaker.
2. At the end of each parliamentary term, such documents will not be released to the public, but will be stored elsewhere.
3. All future Prime Ministers shall be able to request to see such documents, and declassify them if they believe it right to do so.
4. It will become a criminal offense to "leak" the contents of any TOP SECRET documents, regardless as to whether or not the document is currently being discussed in the Cabinet Office or is archived.

Government Contingency Act

Under this bill, the arrangements for contingency government following the vacation of the Office of the Prime Minister will be formalised.
It is noted that the Office of the Prime Minister may become vacant for a number of reasons: - Voluntary Resignation - Compulsion following a loss of the Confidence of the House of Commons. - Death - Any other circumstances in which the Prime Minister is rendered incapable of leading the government.
Therefore, under this bill, all incoming Prime Ministers will be required to inform the speaker of 3 members of the House of Commons, in order of preference, who should be invited to take on the position of Acting Prime Minister in the event of the Office of the Prime Minister becoming vacant. There is no need for the nominations to be made public, nor any need for the individuals to be informed of their nomination.
If the Office of the Prime Minister should become vacant, the Speaker should offer the position of Acting Prime Minister as per the following line of succession: 1st Preference Nominee 2nd Preference Nominee 3rd Preference Nominee The Deputy Prime Minister (or equivalent) The Secretary of State for the Home Office (or equivalent) The Secretary of State for the Foreign Office (or equivalent) The Chancellor of the Exchequer (or equivalent) The Secretary of State for the Cabinet Office (or equivalent) Any other Secretaries of State (with the most experienced being offered the position first) The Leader of the Opposition The Leader of a recognised 3rd Party Group in Parliament The Past Prime Ministers of Ostentia (with the most recent offered the position first) An individual chosen by the Speaker
Obviously, individual MPs may appear more than once on this list, in which case they will not be asked to take up the position a second time. The Speaker is permitted to use his discretion in appointing the Acting Prime Minister, in that he may overlook candidates with security concerns or appoint the highest ranking available candidate should Ostentia find itself in a situation where an Acting Prime Minister is urgently needed.
The position of Acting Prime Minister shall have all the powers invested in the Office of the Prime Minister. However, the position is temporary, and shall immediately cease to exist following the appointment of a new Prime Minister. The Acting Prime Minister may not take any action to prevent the appointment of a new Prime Minister.
If a dissolution of Parliament is called, then the new Prime Minister will be appointed by the Speaker following the conclusion of the election.
If Parliament remains in session, then the Prime Minister shall be chosen by a vote of confidence in the ability of a specific MP to do the job. The Acting Prime Minister may be subject to such a vote, but in the event of a defeat they shall remain in the position of Acting Prime Minister. If after a week in which parliament has been able to sit, no such motion is succesful, it is recommended that the Speaker appoint the Acting Prime Minister to the Office of the Prime Minister.
The fundamental right of the Speaker to appoint the Prime Minister should not in any way be considered restricted by this bill.

Abortion Legalisation Act

Under this bill, abortion will be legalised, provided it is approved first by two qualified doctors to be justified. These doctors will be allowed to prescribe abortion if the following cases are deemed to be present:

Under this bill, the following clause shall be added to the constitution as Article IX.a.1 - Quote:

The rights granted to the citizens of Ostentia by this constitution shall also be considered as granted to the children of Ostentian citizens, limited in so far as they are able to competently exercise their rights. Furthermore, the government shall have a constitutional right to intervene to ensure the welfare of all children in Ostentia, a right which is to be given constitutional status equal to that of the constitutional rights of any individual citizen.
As this bill amends the constitution, it shall require a two-thirds majority vote.
