bank charges; its illegal the amount they charge you

had this email sent to me by a friend thought id share it with you all i rang my bank about it and have managed to get half of my bank charges refunded which is great better than nothing

Regarding: Account number & Sort code

Dear Sir/Madam

Due to recent media coverage on bank charges I now believe that you, Bank Name Here have been charging me charges that are contrary to the Unfair Terms in Consumer Contracts
Regulations 1999. Schedule 2 (e) of the said regulations gives a non-complete list of terms, which may be regarded as unfair, such as a term that requires me as a consumer who fails in his obligation, to pay a disproportionately high sum in compensation.

I believe that your charges are disproportionately high and therefore they are contrary to the Unfair Terms in Consumer Regulations 1999. In addition I believe that your charges are a
Penalty. Penalty charges are irrecoverable at common law.

The precedent for this was Dunlop Pneumatic Tyre Co Ltd v New Garage and Motor co Ltd [1915] AC 79 along with Murray v. Leisure play [2005] EWCA Civ 963. It was held that a contractual party can only recover damages for an actual loss or liquidated losses. It is clear that your charges do not reflect any actual and or real loss.

Furthermore if you fail to comply with this letter, I request without further notice a breakdown and proof of all costs involved, in regards to your actual or liquidated losses involved in any breach of contract to which these charges relate with yourselves, and that these charges reflect your true costs in relation to the said charges, and are proportionate to the charges levied on my account as defined in Unfair Terms in Consumer Contracts Regulations 1999. Schedule 2 (e).

Therefore I require you to refund me a total of £[xxX.xx], representing the total, unlawful amount charged during the last 6 years.

I hereby give you 14 days to refund the charges back on to my account. For the avoidance of doubt, if this is not done within 14 days, I will commence my claim in the courts without further warning. This action will inevitably involve you in additional costs.

I also hereby request a detailed report of which clause in your terms and conditions each charge has been applied against.

hello i tryed this for my son he has leaning diffacults he wont use his card to buy little things up to 3 times a day so he was over drown 3 times a day when he went in to the bank they told hime to take out a bank loan 1000 pound he give most of that away so they give him a nother loan 500 pound then a nother untill i found out he is paying it back the best he can i had to shut down his bank acount so when i phoned them to ask about bank changes they said they could give them becouse he colse his acount they own him a lot of money he as a reading age 4 to 5 and spelling age 6 to 7 so how could he read the adgreement they are b-----d all the best jill

Hi I recently did this and have had a letter back from my bank offering my 1150, i asked for 1300, so I am pretty pleased with the offer.

It only took 3 weeks and 2 letters, they were very quick in responding.

Before this letter on here i had written to my bank (Barclays) and with the help of somebody very good with words, I got back one month's charges as a gesture of goodwill and without them accepting liability. However, i had to sign and agree that it was in full and final settlement.!!!!!
Should this happen again, i will go back at them as they all seem to be flippin robbing us innocent people blind!! They shouldn't be allowed to blind us all with science and get away with it. Good luck to all who do have a go. xx

Hi I find this intresting,my bank have a habit of taking direct debts out before time some times 3 or 4 days before,this then makes me overdrawn for longer.They have just done this with a direct debt that shouldnt go out till the 28 it went out on the 23,giving them 5 days intrest.Think I shall look into this.thanks

i think bang charges are way too high,about 13 years ago i was newly seperated and i was a penny short for my tv licence direct debit,the bank charged me £30 :rant: :rant: CAN YOU BELIEVE THAT,I PHONED THEM TO SAY I WAS WRITING IN TO THE WATCHDOG PROGRAMME,THEY WAIVED THE FEE clap-ping clap-ping I SHOULD THINK SO AS WELL!!
