Exilian reserves the right to terminate any account breaking said rules and regulations. Users will first receive a warning e-mail, stating their transgressions, then a temporary or permanent ban can and will be enforced if the user continues to violate our Terms of Service. IP bans may be used. If we do not enforce our TOS it does not give the user the right to disregard it. </font> <a name="Made to be broken?"><b><font size="2" color="#556F98">Guidelines</b></font></a> <font size="1" color="#C9C9C9"> The Terms of Service are created to provide an understanding of what members are allowed to do and what they are not allowed to do at Exilian: •Ensure a Friendly Atmosphere that fosters friendships between members •Maintain individual privacy for each member •Comply with existing laws •Encourage Freedom of Expression amongst all our members </font> <a name="ToS"><center><u><font size="3" color="#556F98">Terms Of Service</center></u></font></a> <font size="1" color="#C9C9C9"> Exilian reserves the right to warn, ban, or IP ban a member, lower you post count, delete your posts/threads, edit your threads and posts, etc. Any action hampering our jobs will be deemed counter-productive to Exilian and may result in a Ban or a Warning. If actions continue members maybe banned without warning. By registering at Exilian content created by the member is protected by the ToS, disregarding invention rights and ownership of material will be considered a breach of ToS and will result in a ban. </font> <a name="Its your fault, not mine"><b><font size="2" color="#556F98">User Account Related</b></font></a> <font size="1" color="#C9C9C9"> The following will be considered an offence to the TOS and may result in an immediate warning-free ban or IP ban regardless of whether data was lost or stolen: •Hacking or attempting to hack other members’ accounts •Exploiting or attempting to exploit bugs and loopholes in the ToS •Impersonating a member or staff at Exilian •Using Usernames that we deem offensive or inappropriate for a PG-13 forum Users are responsible for the security of their accounts: it is THEIR FAULT if they willingly or accidentally give out their password. Users are also responsible for all posts they write here with the exception of a hacked account. Exilian reserves the right to terminate accounts whose usernames don’t comply with the TOS, we may ask a member to rename his account, an Admin will then rename it. </font> <a name="Are they litterally black?"><b><font size="2" color="#556F98">Blacklisted Sites</b></font></a> <font size="1" color="#C9C9C9"> Sites with the following criteria will not be associated in any way with Exilian as they are against our ideas and values. Any member publicly supporting or advertising these sites will be immediately perma banned: •Sites promoting racism or sexism •Neo-Nazi sites •Anti-Semite sites •Stormfront Sites •Sites promoting slavery •Sites promoting cruelty towards humans or animals </font> <a name="Trollz"><b><font size="2" color="#556F98">Spamming and Flamming</b></font></a> <font size="1" color="#C9C9C9"> Unless the thread is started in “The Boozer”, Spamming will not be tolerated and will result in the deletion of the thread, a warn being issued to the member in question, and possibly a ban; the following are considered spamming: •Repeated posting of off-topic threads •Posting in all-capitals •Flooding the forum with the same message •Post count raising threads •Inciting a forum war or riot •Advertisement •Parasitic messages (chain-letters…) •Free ____ links (Ipod, Computers…) Flaming is the action of attacking another member verbally; flaming is also not tolerated and may result in a temporary ban regardless of precedent actions and who started the fight. Flaming includes but is not restricted by the following: •Repeated insults or insinuations about a member •Slander against a member Racist and hate speech will not be tolerated and will result in the severest form of punishment Exilian can give. </font> <a name="Pirate"><b><font size="2" color="#556F98">Cracks, Keygens, Warez, etc...</b></font></a> <font size="1" color="#C9C9C9"> <<“Piracy” is the illegal copying and/or distribution of copyrighted content including, but not limited to, games, software, music, movies, pictures, ROMs, abandon-ware, and leaked software. “Cracks” are programs that disable copy-protection technology; “Multiplayer Hacks” are any programs, patches, files, modifications or information exposure cheats that allow a player to gain an unfair advantage over other human opponents in a multiplayer game; a “Key” is a combination of numbers and letters that is required for software installation and sometimes used to validate users for online play; and “Key-Generators” are programs that generate valid Keys.>> As defined by HeavenGames. Users are not allowed to encourage the use of the above, to post on the forums about the above, to create any of the above on Exilian, Members are also not allowed to share techniques on how to make cracks, locations on were to get cracks. The following will be considered as against the ToS and may result in either a deleted post and warning, or a ban, temporary or permanent depending on the offence: •Posting locations of where to obtain cracks/keygens and other pirated material •Seeking help on where to find cracks/keygens or seeking help to create a crack/keygen •Asking for files larger than 10 MB of a game that normally come with the installation CD (exceptions include: Main exe file. File size may be adjusted depending on what the purpose is.) •Admitting to possessing, creating, using, or distributing pirated material. •Posting links to pirated material at Exilian </font> <a name="Cussing your a off"><b><font size="2" color="#556F98">Swearing</b></font></a> <font size="1" color="#C9C9C9"> Excessive swearing will result in a warning and temporary ban for repeated offenses. We understand that you use swear words once and a while but please don’t abuse our trust. Please do not post links to the swear word you are trying to use to bypass the consequences. Exilian staff reserves the right to edit any post that contains too many swear words or is offensive to other cultures or religions, messages with strong pornographic content will also be edited, a warning may be issued followed by a ban. Do not re-edit a message staff has edited to re-write your original post, doing so will result in deletion of the post and a temporary ban. </font> <a name="Porno...Mmmm"><b><font size="2" color="#556F98">Pornographic Content</b></font></a> <font size="1" color="#C9C9C9"> Invisionfree requires that this forum be kept at a PG-13 level, that is, nothing unsuitable for the eyes of a 13 year old may be posted here. Posting of pornographic text, images, video, and sounds will be edited out of the post and will result in a warning followed by a ban if repeated. Posting links to porn sites or images with the following in them are also against the rules: •Posting pictures of nude people (not necessarily penalized according to context) •Posts with vivid sexual imagery •Images depicting sexual intercourse either gay or straight •Audio with orgasmic sounds •Posting pictures of people wearing revealing clothing (past a certain degree and within a certain context) We really want to keep the forums a nice place to meet and speak together, please don’t ruin it with porn. </font> <a name="ZOMGZORZ Blood!"><b><font size="2" color="#556F98">Violent and Shocking Images</b></font></a> <font size="1" color="#C9C9C9"> Posting pictures with excessive gore, blood or violence will be edited out. Likewise posting pictures of shocking events such as suicides will be edited out. A short list of what is not allowed: excessive blood and gore, dismemberment, violent deaths, etc… You may not link to such images either. If a member posts images repeatedly he will be warned or banned. </font> <a name="Popo is after yo"><b><font size="2" color="#556F98">Illegal Use</b></font></a> <font size="1" color="#C9C9C9"> You may not use the forums to conduct, direct, plan, or encourage illegal activities as determined by the laws of the United States of America and the laws of Great Britain. Doing so will result in an IP ban and the authorities may be contacted. </font> <a name="Da lingo"><b><font size="2" color="#556F98">Official Language</b></font></a> <font size="1" color="#C9C9C9"> The official language spoken at Exilian is English (both USA and GB), please refrain from posting in any other language for a prolonged duration (ie: you may use other languages in small amounts). If you have trouble understanding a post you may contact a member of the Staff. </font> <a name="Snail Mail"><b><font size="2" color="#556F98">E-mail Adress</b></font></a> <font size="1" color="#C9C9C9"> You must have a valid and working e-mail address registered at Exilian at all times in the event of a warning or other message. Exilian will never give out your e-mail address to other people without your consent. If a message sent to your account bounces you will be banned and will have to contact a moderator to be unbanned, your e-mail address will then be verified before you are unbanned. </font> <a name="Banhammer"><b><font size="2" color="#556F98">Bans</b></font></a> <font size="1" color="#C9C9C9"> You may not avoid a ban by creating a new account, doing so will lengthen your ban time, if you think you do not deserve your ban, contact a staff member and they will decide whether you may be unbanned earlier (as a group). Publicly complaining about your ban will also result in a lengthened ban time. You may not get another member to post on the behalf of a banned member; the poster may also receive a ban. </font> <a name="Bit long no?"><b><font size="2" color="#556F98">Conclusion</b></font></a> <font size="1" color="#C9C9C9"> Exilian is a non-commercial site staffed by volunteers. We cannot ensure that this ToS is completely respected: some of our staff members may be under the age to be bound by legal contracts; furthermore, we don’t have any lawyers so we can’t be sure that we will be able to enforce our Terms of Service.
