It is clear that the Global Union of Nations, in order to form a more perfect union, provide for the general welfare, and protect the liberties of the people and their governments for which are recognized in the Global Union of Nations organization, I Consertino, President of the GUN hereby address the following Judicial System to be used by our nations. Article I. The Divine Court Section I. The highest to serve for all Global Union of Nations shall be named the Divine Court. Section II. There are two types of cases that may be heard by the Divine Court, Civil and Criminal. Article II. the Chief Justice Section I. The President of the Global Union of Nations must appoint a Chief Justice to serve a 20 day term as judge. Section II. If the 20 day term of the Chief Justice is to last beyond the term of the current President, the Chief Justice will still be entitled to finish 20 days worth of work. Section III. A Chief Justice may be entitled to serve as many terms as he is appointed to. Section IV. The Office of the Chief Justice recieves responsibilities of hearing out cases, sentencing, and Deciding disputes in Civil Cases. Section V. No Chief Justice appointment will have a population less than twenty million. Nor shall the Chief justice be a non-forum member, and the Chief Justice as with every other position should be an involved nation in G.U.N. politics. Section VI. If the scenario that a Chief Justice resigns or ceases to exist or is fired by the President, Secretary-General, and Delegate with majority vote, or removed from office by the Senate the President must appoint a new one. A Senate Impeachment is superior to the decision of the Executive Branch. An Impeachment measure for all positions must have a 1-Day vote in the Senate and does not require a specific start day or being in the hopper. But a vote of removal from office requires 75% majority and must be suggested after the 7th Day of the term unless one of them brakes GUN rules. Article III. Civil Cases, Criminal Cases, and Positions. Section I. A Civil Case is a dispute between two parties that may interfere with laws of member states, ethics, and any dispute that does not involve the Constitution, Ammendments, or Laws created by the Senate of the Global Union of Nations. Section II. The party for which introduces the civil case is the Sanction. Section III. The party for which defends against the Sanction's claims is the Defendent. Section IV. A Civil Case is heard by a Chief Justice only and does not require a jury. Section V. A Criminal Case involves two parties and involves someone accused of breaking the Constitution, Laws, and Ammendments. Section VI. Both a nation and the GUN government may accuse another party of breaking the law. The party that has accused the other party is the Prosecution. Section VII. The party for which is defending and the accused is the Defendent. Section VIII. A Jury of three decided if the Defendent is guilty or not guilty within a criminal case. If guilty the Cheif Justice sentences the Defendent he/she must create bassed on history of similar cases, crime, the law, and must not sentence to any cruel or unusual punishment. Article IV. Juries & Court Scheduling Section I. The parties, jury and judge must compromise on a date and time. Section II. A Case may be adjourned for the day and take multiple days. But 30 minutes at least must be used for court time in one day. Section III. In order for the Divine Court to hear a case a party must submit it by contacting the Chief Justice. Section IV. Juries of three will be chosen and can use the forum to chat. The Juries of course must be a forum member. Section V. A selected juror must be telegramed and report back within 72 hours or the Chief Justice may have to appoint a new one. Section VI. If a selected juror refuses to respond back or show up it is a crime. Section VI. If the Sanction or Prosecution is not present at the compromised time, the Defendent is pardoned and all assets are given to the Defendent. Assets will be stated by the Chief Justice at the beginning and end of a trial. Section VII. If the Defendent fails to attend he is automatically convicted and sentenced by the Jury. Section VIII. In order to legally not be present or fail to attend you must be over 7 minutes late. Section IX. If either party does not respond to a question or statement within 15 minutes they lose the case. Section X. In order for a jury to decide a verdict they must vote, majority rules, no abstaining, this may take a couple days , but no more than 7 or that would be illegal and the case is dropped. Article V. Double Jeopardy Section I. No one can accuse another of the same crime twice unless it is commited again. Section II. If the scenario in Article IV, Section X apply the Prosecution or Sanction may sue once more. Section III. If a proven crime of judicial knowledge to seek victory by cheating out another occurs, the case may be repeated. Article VI. Inter-Regional Lawsuits Section I. Inter-Regional Lawsuits may occur for both types of cases and those rules apply. Section II. If A Criminal Lawsuit is the case than a jury of 5, the Chief Justice, 2 G.U.N. members, and two of the other party members shall partcipate in the Jury. |
