car accident question

my mom was in an accident a year ago and the car was totaled. i have court tomorrow(lawsuit) since we couldnt settle with their insurance company since it was his fault. my question is, with the lawsuit money my mom and i will be recieving, she was giving me the $ to put into Knight rider conversion. i want to do something nice for her and rebuy her car and try and get it fixed since it had sentimental value. my question is, is there any way to track down where the car is located if i have the vin #? and without going to the body shop. thanks

Totals usually get parted out, if someone fixed it, run the vin through DMV if it shows up it should be under a salvage title by law. But it's prolly parted n crushed by now. Like my avalanche.

You dont understand it was a car my dad gave her who recently passed. Thats why i wouldnt both getting another. It would have to be that one. And it hasnt been a yr since it left body shop its been more like 6 months if that

Careful counting your chickens....Car accidents happen everyday, the likely hood of paying out more than the blue book value of the vehicle and doctors bills beyond what health insurance covered is very slim. Getting a bank load from an accident suit doesn't happen like it maybe did in the past. Reason I say this is because you say your mothers car had sentimental value, thus usually meaning low in real monetary value. Also being the accident was over a year ago, unless this was an ongoing case from over a year ago. The ability to prove any real injuries as the prosecutor, and the time for the ability of the defending party to investigate so called injuries has passed. Making it hard to reach any agreement at all. Just something to throw out there. You may have to go through arbitration to get even a dime.

I have been through it, though not with a car accident. Sometimes the best thing you can do is settle before arbitration, but that's where a good lawyer comes into play.

Also as far as the car goes, its most likely scrap by now. It wont hurt to spend a minute or two looking for it. Best bet is if you mother is anything like 90% of mothers out there it is only visually sentimental. If you can get the same year, make, model, color, and put a nice story behind it you will be in good shape. :)

Well what happened was it got postponed one becaus ethe guy was sick. Then the second time it got postponed again because the guy died day before. So now this time were going after the wife in small claims. My mom tried to settle they refused...im confident ill win because we have a witness statement saying this guy was at fault and the police report states he failed to yield to stop sign

You, or your mothers insurance didn't cover anything? I am curious now to know were you or your mother seriously injured?

Its sounds awful to me to that you are even attempting to sue a Widow whose husband just passed. He was at fault how...Did he intentionally depress the accelerator in hopes to engage in a life altering impact of two vehicles? Or did he merely just "accidentally" miss a stop sign? Don't be too confident, accidents happen, and the guy involved is no longer living.

It is surprising to me that you are even contemplating spending "blood money" on recreation.

If you take offense to anything I said, or where aggravated by it in anyway...Be prepared to take 100x that in ct.

We have no choice but to go after her. Car is not covered by collison. We tried to settle. They wouldnt. Not our fault. And to be honest, i respect the fact her husband passed but that doesnt resolve the fact that he was at fault for the accident and damaged a vehicle

If she wasn't driving and he was and had died I don't think you'll get anything. If she wasn't driving it's not her fault, I'm pretty sure they will just dismiss the case.

That's if he didn't owe more money than he actually had, which sadly is the case in America more times than not. Other wise bills will be taken care of before anything is done with it.
